The Charity Commission for Northern Ireland has welcomed the Charities Act 2008 (Transitional Provision) Order (Northern Ireland) 2013, which comes into effect today (19 August 2013).
The Order will increase the number of charities to which the Commission’s powers apply – effectively granting the Commission jurisdiction over all Northern Ireland organisations which have registered with Her Majesty's Revenue and Customs (HMRC) for charitable tax purposes to date.
Frances McCandless, Chief Executive of the Commission, commented: "This has been a very busy year for the Commission as we continue to prepare for beginning full charity registration in the autumn, along with our ongoing regulatory and compliance work.
"We are delighted the Transitional Provision Order has been made, allowing us to go ahead and make decisions on a wide range of areas, from giving consent to governing documents changes to granting cy-près schemes, as well as increasing the number of charities to which our powers apply."
In order to work with, and regulate, charities in Northern Ireland, the Commission must first be able to categorise which organisations are charities. Charity registration will begin later this year, with more information to follow soon.
In the interim period, the Commission deems organisations which had registered with Her Majesty's Revenue and Customs (HMRC) for charitable tax purposes to be charities.
An earlier deemed list of Northern Ireland charities, which can be viewed online here, was created on 18 February 2011 under the Charities Act 2008 (Transitional Provision) Order (Northern Ireland) 2011.
Under that Order, the Commission gained jurisdiction over charities on the deemed list, including gaining powers, available for the first time in Northern Ireland, to investigate apparent charity misconduct and mismanagement.
The new Transitional Provision Order will increase the number of charities over which the Commission has jurisdiction, with effect from Monday 19 August 2013.
The Commission will now liaise with HMRC to create a new, up to date deemed list, which will be published on the Commission’s website www.charitycommissionni.org.uk
